How do I calculate the new Life Pension weekly rate after commuting the attorney fee?
1.Click on Present Value Commutation
2.Click on Life Pension – Enter Payment and Amount
3.Click on Present value. Present value is displayed. Decide on attorney fee. 15% of present value is $147,895.31
4.Click on Sum Commutation Reduction of Payment button in lower right hand corner.
4.Enter attorney fee. Life pension is reduced from $490 to $416.50
The user will need to enter the correct date of injury and date of birth and male/female. Note that SAWW is assumed to be 4.85%.
A judge may not allow 15% of present value as attorney fee. Most judges allow 12% of present value.
